1. Introduction

Hard Money Lenders of Breckenridge (the "Site") is a lead generation service operated by Lead Skills, LLC ("we," "our," or "us"). We are not a lender. We connect borrowers who submit inquiries through this Site with one or more participating hard money lenders that may be able to provide financing. Because we collect nonpublic personal financial information in connection with a financial product or service, our handling of that information is subject to the Gramm-Leach-Bliley Act ("GLBA"), the Safeguards Rule, and the Privacy of Consumer Financial Information Rule. This Privacy Policy explains what we collect, how we use it, how we share it with participating lenders and service providers, and the choices you have about that sharing.

2. Information We Collect

We collect the following categories of information when you submit an inquiry, interact with the Site, or communicate with us:

• Identifiers: full name, email address, phone number, and mailing address you provide.
• Property and investment information: property address, property type, purchase price, estimated value, rehab budget, timeline, and other deal details you choose to share.
• Financial information: requested loan amount, loan purpose, desired term, self-reported credit range, available down payment, real estate investing experience, and other nonpublic personal financial information necessary to match you with participating lenders.
• Usage data: IP address, device and browser type, referring URL, pages viewed, time on page, and interactions with the Site collected through cookies and similar technologies.
• Communication records: records of your calls, emails, text messages, and form submissions, including the date and time of your TCPA consent.

3. How We Use Your Information

We use the information we collect to:

• Match your inquiry with one or more participating lenders that may be able to provide financing.
• Facilitate communication between you and participating lenders and respond to your questions.
• Operate, maintain, troubleshoot, and improve the Site and our lead generation service.
• Send service, transactional, and, where permitted, marketing communications.
• Detect and prevent fraud, abuse, and security incidents, and enforce our Terms of Service.
• Comply with legal obligations and respond to lawful requests from regulators and law enforcement.

4. How We Share Your Information (GLBA Disclosure)

We disclose the nonpublic personal information described above to the following categories of recipients, in the manner permitted by GLBA:

• Participating lenders: When you submit an inquiry, we share your information with one or more participating hard money lenders so they can evaluate your inquiry and contact you about financing. A current list of participating lenders is available upon request.
• Service providers: We share information with vendors that help us operate the Site and our service, including hosting, analytics, email delivery, SMS delivery, CRM, call tracking, fraud prevention, and security providers. These service providers are contractually required to use your information only to perform services for us.
• Legal and safety: We may disclose information when we believe in good faith that disclosure is necessary to comply with a subpoena, court order, or other legal process; to cooperate with law enforcement; to enforce our Terms; or to protect the rights, property, or safety of our users, our company, or others.
• Business transfers: If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, receivership, or sale of assets, your information may be transferred as part of that transaction.

We do not sell your nonpublic personal information.

5. Your Right to Limit Sharing

Because we are a lead generation service, submitting an inquiry through the Site authorizes us to share the information you submit with one or more participating lenders so they can contact you about financing. If you do not want your information shared with participating lenders, do not submit an inquiry form.

After submission, you may opt out of future marketing contact from us by replying STOP to any text message, clicking "unsubscribe" in any marketing email, calling us at 970-717-2119, or emailing us at [email protected]. To opt out of further contact by a participating lender that has received your inquiry, please contact that lender directly.

6. Data Security

Consistent with the GLBA Safeguards Rule, we maintain a written information security program that includes administrative, technical, and physical safeguards designed to protect the security, confidentiality, and integrity of the nonpublic personal information you provide. These safeguards include access controls, encryption of data in transit, secure development practices, vendor risk management, and periodic review of our security posture. No system is fully secure, however, and we cannot guarantee absolute security of information transmitted over the internet.

7. Your Choices

• Access and correction: You may request a copy of the information we hold about you or ask us to correct inaccurate information by contacting us at the details below.
• Deletion: You may request that we delete the information we hold about you, subject to exceptions required or permitted by law (for example, to comply with recordkeeping obligations).
• SMS opt-out: Reply STOP to any text message from us to stop further text messages. Reply HELP for help.
• Phone opt-out: Ask the caller to place you on our internal do not call list, or call us at 970-717-2119.

8. Children's Privacy

The Site is not directed to children, and we do not knowingly collect personal information from anyone under the age of 18. If we learn that we have collected information from a child under 18, we will delete it.

9. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will revise the "Last Updated" date at the top of this page. Changes become effective when posted. Your continued use of the Site after an update means you accept the revised policy.
