Terms of Service

1. Introduction and Agreement

These Terms of Service (the "Terms") govern your access to and use of Hard Money Lenders of Breckenridge (the "Site"), operated by Lead Skills, LLC ("we," "our," or "us"). By accessing the Site, submitting an inquiry, or otherwise using our service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Site.

2. Our Role: Lead Generation Service

The Site is a lead generation service. We connect borrowers who submit inquiries through the Site with one or more participating hard money lenders that may be able to provide financing. We do not make loans, extend credit, take loan applications, issue loan commitments, set rates or terms, or make any credit decisions. All credit decisions, loan approvals, interest rates, points, fees, repayment terms, funding timelines, servicing, and collections are the sole responsibility of the participating lender.

3. No Offer or Solicitation

Nothing on the Site constitutes an offer or commitment to lend, an offer to enter into any financial agreement, or a solicitation of a loan. Information on the Site is provided for general informational purposes only and is subject to change without notice. Any rates, terms, timelines, or program features described on the Site are illustrative and reflect examples of what participating lenders have offered in the past. They are not a quote and are not binding on any lender. Submitting an inquiry does not guarantee that you will be matched with a lender or receive a loan offer.

4. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract to use the Site. You agree to provide accurate, current, and complete information in any inquiry you submit, and to update that information if it changes. Submitting false, inaccurate, or misleading information may result in denial of service, rejection by participating lenders, or other consequences.

5. Your Consent to Be Contacted

By submitting an inquiry and checking the consent box on our form, you provide your prior express written consent for us and one or more participating lenders to contact you at the phone number and email address you provided, including by autodialer, prerecorded or artificial voice, SMS/text message, and email, regarding your financing inquiry. You understand your information will be shared with one or more participating lenders who may contact you. Consent is not a condition of receiving any services or obtaining a loan. Message and data rates may apply. Message frequency varies. You can opt out at any time by replying STOP to any text message or calling 970-717-2119. A current list of participating lenders is available upon request.

6. Equal Opportunity

We connect borrowers with lenders who are Equal Opportunity Lenders. Participating lenders do not discriminate on the basis of race, color, religion, national origin, sex, familial status, disability, marital status, or age.

7. Acceptable Use

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms.
• Submit inquiries on behalf of a third party without their authorization, or submit false, fraudulent, or misleading information.
• Attempt to interfere with, disrupt, damage, overburden, or gain unauthorized access to the Site or related systems.
• Scrape, harvest, or use automated means to collect information from the Site without our express written consent.
• Reverse engineer, decompile, or attempt to derive source code of any part of the Site.

8. Intellectual Property

The Site, including its text, graphics, logos, images, software, and underlying code, is owned by Lead Skills, LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial use. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use our content without our prior written permission.

9. Third-Party Links and Services

The Site may contain links to or integrations with websites, services, or content operated by third parties, including participating lenders. We do not control, and are not responsible for, third-party websites, services, content, terms, or privacy practices. Your interactions with any participating lender, including any loan application, agreement, disclosure, or dispute, are solely between you and that lender.

10. Disclaimers

THE SITE AND ALL CONTENT, SERVICES, AND MATERIALS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; THAT DEFECTS WILL BE CORRECTED; OR THAT THE SITE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THAT ANY INQUIRY WILL BE MATCHED WITH A LENDER OR RESULT IN A LOAN OFFER.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL LEAD SKILLS, LLC OR ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SITE, YOUR INTERACTIONS WITH ANY PARTICIPATING LENDER, OR ANY LOAN OR FINANCING DECISION MADE BY A PARTICIPATING LENDER, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).

12. Indemnification

You agree to defend, indemnify, and hold harmless Lead Skills, LLC and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Site, your violation of these Terms, your violation of any applicable law, or your violation of any third-party right.

13. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Site will be resolved in the state or federal courts located in Summit County, Colorado, and you consent to the personal jurisdiction of those courts.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date above. Changes are effective when posted. Your continued use of the Site after an update means you accept the revised Terms. If you do not agree to the updated Terms, you must stop using the Site.
